What are USGovBid’s Bidding Terms & Conditions?

By making a bid and being declared the winning bidder, you enter into a binding contract. Under New Jersey law (see N.J. Stat. § 12A:2-328), once the auctioneer announces the sale, you are legally obligated to pay for the item. Failure to pay may result in legal action to enforce the contract, loss of any deposits, and recovery of costs associated with resale or collection.

What happens for nonpayment on lots that were won?

2A:14-1. a. Every action at law for trespass to real property, for any tortious injury to real or personal property, for taking, detaining, or converting personal property, for replevin of goods or chattels, for any tortious injury to the rights of another not stated in N.J.S.2A:14-2 and N.J.S.2A:14-3, or for recovery upon a contractual claim or liability, express or implied, not under seal, or upon an account other than one which concerns the trade or merchandise between merchant and merchant, their factors, agents and servants, shall be commenced within six years next after the cause of any such action shall have accrued.

 

b. This section shall not apply to any action for breach of any contract for sale governed by N.J.S.12A:2-725.

 

c. The period of time for the filing of a claim by a condominium association, cooperative corporation, or other planned real estate development association against a developer or any person acting through, on behalf of or at the behest of the developer under subsection a. of this section, shall be tolled until an election is held and the owners comprise a majority of the board pursuant to paragraph (3) of subsection a. of section 5 of P.L.1993, c.30 (C.45:22A-47), or subsection d. of section 2 of P.L.1979, c.157 (C.46:8B-12.1). Any cause of action involving a condominium, cooperative, or other planned real estate development under the provisions of subsection a. of this section that has not been subject to a final judgment dismissing the claim as of the effective date of P.L.2021, c.379 shall be subject to the terms of this subsection.

Are there special conditions?

NOTICE: All property being sold via this auction site is sold “As Is – Where Is”.
No Sale will be set aside due to errors in the description or for property not personally inspected by the Buyer.
INSPECTION IS STRONGLY RECOMMENDED.
The buyer is responsible for ALL loading and transporting of property.
Documentation must be provided if property is to be released to anyone other than the listed buyer.
The Seller and Auctioneer doesn’t offer packing or shipping services and cannot recommend any particular shipping company.

What happens when an auction is closing and after it closed?

You will receive an email by the next business day if you are the winning bidder, with instructions on how to make payments and where to pick up your items.

We have a feature called extended bidding. This feature will leave the bidding open for 3 minutes on any item that has received a bid within the last minute from the last recorded bid time, even if the the ending time has been reached. This feature has been added to eliminate sniping and to make the online bidding process more like a ‘live’ auction.

How do I make a payment?

All bidders understand that all high bids for items up for auction are subject to Seller’s confirmation. The high bidder will be the next business day of the Sellers confirmation. All payments must be made within 24 hours by Wire Transfer or overnight Cashier’s Check to Auction Liquidation Services, 300 Commerce Drive, 1st Floor, Tinton Falls, NJ 07753.

What is the invoicing process?

Auction Liquidation Services acts solely as an agent for the selling government agency or cosigner. The winning buyer’s payment will be collected on behalf of the seller and may take up to 15 to 30 days for the payment to be deposited and cleared until the entire auction is closed. This ensures proper invoicing and accounting credit adjustments are accurate and that the item has been removed, delivered, and proper shipping arrangements have been made. In the event that the auction is voided in arbitration the winning buyer’s payment will be returned.

What happens due to late payment; failure to complete sale?

If the winning bidder fails to pay the purchase price and other associated fees before the payment deadline then the winning bidder must pay to Auction Liquidation Services a late fee equal to 2% of the purchase price. If the winning bidder fails to make full payment of the purchase price and other fees within five (5) days after the auction, such winning bidder shall be deemed in default of its obligations in connection with the bid and shall forfeit its rights to purchase the goods, in which case the Seller may sell the goods to another bidder. If the winning bidder is in default as set forth herein, a Default Penalty will be assessed to the winning bidder in the amount of $1,500 or the dollar amount of the invoice, whichever is less, and the winning bidder will be barred from bidding on other auctions on the marketplace until the Default Penalty is paid. The Bidder will also have to pay a $250.00 non returnable fee to Auction List Services to be able to be allowed to have the privilege of bidding again. The Default Penalty must be paid to Auction Liquidation Services by cashier’s check or wire transfer. In the event of a default as set forth in these Terms and Conditions and as is allowable in accordance with the laws of the State of New Jersey, the winning bidder may be subject to other claims, damages or liabilities to the Seller and/or Auction Liquidation Services.

How do I remove an my winning item?

The high bidder is leaving their item at their own risk. The Auctioneer/Auction Site is not responsible for damaged or stolen property. No adjustments will be made. We encourage immediate removal of your items after payment.

There will be NO WEEKEND releases. After the final removal date there will be a storage fee charged to the Buyer. If merchandise is not removed within 10 days of the final removal date, the ownership of the merchandise will revert back to the original Owner/Seller. The Owner has the right to sue for collection of such charges. Merchandise becomes the full responsibility of the Buyer at the time the Buyer takes possession and Buyer assumes all risk of loss and damage to property at that time.

What inforamtion can you provide about the item/lots descriptions?

The descriptions of item/lots appearing in the auction and in advertising prior to the auction are believed to be correct. Nevertheless, the Auctioneer is not responsible for the correct description, year, make, model, VIN#, mileage, authenticity, genuineness or defects in any lot and makes no warranty. Auctioneer is not responsible for any items that are removed from law enforcement or county service vehicles by said law enforcement agency or County. ALL SALES ARE FINAL. No deduction will be allowed on damaged articles as all goods being exposed for public auction are sold “as is – where is” and with all faults. Bidder acknowledges that all item/lots were available for inspection prior to the auction and the Auctioneer and Owner/Seller strongly encourages the Bidder to carefully inspect each item/lot in which the Bidder has any interest to determine the item/lots condition, quality and size. Bidder relied solely on personal inspection and not on information listed on the Site or otherwise provided by Auctioneer or Owner/Seller. Bidder’s failure to inspect or to be fully informed will not constitute grounds for any claim, adjustment, and refund, termination of the contract for sale or refusal to close the sale, against Auctioneer or Owner/Seller.

Are there any disclaimers?

Auctioneer is providing services as an independent contractor for the Owner/Seller only and is not responsible for statements made by other parties.

Auctioneer cannot and will not be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free services or use of the Site. Bidder acknowledges that the auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final.

Auctioneer gathers information about Bidders and Owner/Sellers for the purposes of conducting online auctions. Auctioneer does not sell or rent this information.
All bidders understand that all high bids for items up for auction are subject to AGENCIES/SELLERS CONFIRMATION. The Auctioneer reserves the right to reject any bid/bidder in the best interest of the seller.
